Surface Water Right Types

You’ll gain insight into California’s unique blend of two different kinds of water rights and their historical development. You’ll understand the "first in time, first in right" principle and discover how to quickly access a list of water right types.

You’ll explore the background and significance of the Water Commission Act.

You’ll learn key riparian water rights terminology and gain a thorough understanding of riparian rights, riparian lands, and related practices. You’ll also discover the difference between natural flow and foreign water. We’ll illustrate water right priority with three scenarios specific to riparian rights.

You’ll learn the definition of appropriative water rights , including pre-1914 appropriative rights, and the concept of water diversion quantity growth, priority, and conditions for non-use. This will help you to distinguish between pre-1914 and post-1914 water rights.

You’ll explore post-1914 appropriative water rights and their sub-types. You’ll also be introduced to California water rights laws and regulations, with guidance on where to find them online. We’ll have case studies to walk you through a water right permit and a license. From there, you’ll get a summary of the major water right components.

You’ll explore the history of California’s colonization, including the establishment of pueblos, missions, and presidios, to understand Pueblo water rights and the eligibility of its right holders. You’ll also learn about its priority, water sources and water use, conditions for non-use, and due diligence.

You’ll learn about Federal Reserved rights by discovering five U.S. Supreme Court cases. This will include an exploration of the Doctrine, the adjudication process, the extent of federal reserved rights, the role of groundwater in these rights, and the limitations on their purposes of use.

You’ll explore State Filed applications and the two methods for using the water reserved in these applications: “Assignment” of and “Release from Priority” of a State Filed Application. Additionally, you’ll learn about priority considerations in water availability analysis, and the calculation of face values.

Water Rights Information & eWRIMS

You’ll learn the background history of eWRIMS, gain an understanding of the eWRIMS database system, and explore the eWRIMS Web Mapping Application (GIS) and the eWRIMS Report Management System.

You’ll begin with a brief overview of the Records Search entry page. We’ll then demonstrate two different data queries for searching a water right. Finally, we’ll discuss dataset quality and data inconsistencies to ensure you don’t overlook important records in your searching.

We'll guide you through the Public Summary Page, which displays search results from the eWRIMS Water Rights Records Search, and use a case study to demonstrate the searching process, and walk you through its water right documents to help you understand the relevance of the included documents and the water right information they cover.

We'll provide a brief overview of the California water rights permitting process. You'll learn about the three key water right documents: application, permit, and license. With a case study, we’ll guide you through all the items in the document so you can efficiently locate the information you need.

We’ll use a California Department of Water Resources water right permit as an example to demonstrate how to access a permit. Following that, we'll walk you through the permit to familiarize you with the included information and terms and conditions. Additionally, we'll show you the attached order related to this permit, which provides updates about it.

We’ll use a U.S. Bureau of Reclamation’s water right license as an example to demonstrate how to search for and access a license. After that, we’ll provide a 'Water Right License Walkthrough' to familiarize you with the information and terms and conditions. We’ll also compare a permit and a license to highlight the differences between them, based on their phases in the water right application process

Water Transfer - Fundamental

You’ll learn what a water transfer is, including transferrable water, regulatory approvals, and the major components involved in a water transfer.

You will learn about the four general categories of water transfers, which are: short-term versus long-term water transfers, surface water versus groundwater transfers, post-1914 versus pre-1914 water transfers and contract water transfers, and in-basin versus imported water transfers.

We’ll cover the authority for short-term transfers of stored water and outline the three criteria for such transfers. We’ll also discuss stored water from a water rights perspective, address reservoir refill, refill criteria, and refill agreement, and discuss potential injury with three examples.

We’ll cover the authority for short-term transfers of direct diversion and outline the three criteria for such transfers. You’ll explore the three types of "consumptively used" water and the distinction between reduction in diversion and reduction in consumptive uses.
